Questioning the Mexican citizenship of Pablo de la Guerra and his legal right to hold office in the State of California. Under the Act of 1863 "no person shall be eligible to the office of District Judge who shall not have been a citizen of the United States..." There was opposition to De la Guerra taking office, but he was found to be a citizen by virtue of birth in Santa Barbara in 1819.
